Heal Earth Curriculum: Terms and Conditions for Schools

These Terms and Conditions (“Terms”) govern the purchase, license, and use of the Heal Earth Curriculum, including lesson packs, digital assets, Digital Portfolio templates, and training materials (collectively, the “Curriculum”) by educational institutions (“Schools”).
1. Licensing and Grant of Use
1.1. Single-Site License: Upon payment of the applicable fees, Heal Earth grants the School a non-exclusive, non-transferable license to use the Curriculum for internal educational purposes at a single physical location.
1.2. Multi-Site/Trust Licenses: Multi-academy trusts or school districts requiring use across multiple sites must purchase a "Trust-Wide License." Sharing materials between schools without a Trust-Wide License is a breach of these Terms.
1.3. Classroom Use: Teachers at the licensed School may print, photocopy, and digitally distribute the materials (including Portfolio templates) to registered students for classroom and homework use only.
2. Intellectual Property
2.1. Ownership: All content within the Curriculum, including but not limited to the "Systems Sprites" characters (Hydro, Volt, Nutri, Techno, Nova, Pax, etc.), storylines, instructional scripts, and interdisciplinary matrices, remains the sole property of Heal Earth.
2.2. Restrictions: Schools may not:
Modify, rebrand, or create derivative works of the Sprites or characters for commercial sale.
Record or broadcast teacher training sessions without written permission.
Remove copyright or trademark notices from any printed or digital materials.
3. Digital Assets and Portfolios
3.1. Platform Responsibility: Heal Earth provides the templates and structures for the Digital Eco-Portfolios. The School is responsible for the hosting environment and the security of the platforms used to store student data.
3.2. Content Ownership: Students and Schools retain ownership of the "Artifacts" (photos, videos, drawings) uploaded to their portfolios.
3.3. Data Protection: The School acts as the Data Controller for all student information. The School must ensure that use of the Portfolios complies with local data protection laws (e.g., GDPR, FERPA, UK Data Protection Act).
4. Health, Safety, and Risk Assessment
4.1. Sensory Activities: The Curriculum involves physical interaction with the environment (e.g., mud play, soil exploration, wind testing, and building prototypes).
4.2. School Responsibility: It is the sole responsibility of the School and its staff to conduct site-specific Risk Assessments for all "Practice" activities.
4.3. Allergies and Sensitivities: Schools must monitor students for soil-borne allergies, skin sensitivities, or respiratory conditions during activities involving raw earth materials or simulated "soot" experiments.
4.4. Limitation of Liability: Heal Earth provides pedagogical guidance but shall not be held liable for injuries, property damage, or health issues arising from the School's delivery of outdoor or laboratory-based activities.
5. Payment and Delivery
5.1. Purchase Orders: We accept official School Purchase Orders. Invoices are payable within 30 days of the invoice date unless otherwise agreed in writing.
5.2. Digital Delivery: Curriculum Lesson Packs and Portfolio templates are delivered digitally. Access will be granted upon receipt of payment or an official Purchase Order.
5.3. Refunds: Due to the nature of digital goods, Heal Earth does not offer refunds once the digital assets have been accessed or downloaded.
6. Neuro-Inclusive Commitment
6.1. Adaptation: Schools are encouraged to utilize the "Local Adaptation Toolkits" provided to ensure the curriculum meets the specific cultural sensory and cognitive needs of their students.
6.2. Pedagogical Fidelity: To maintain the efficacy of the curriculum, Schools agree to adhere to the four-stage instructional script (Prepare → Learn → Practice → Reflect) where possible.
7. Termination
7.1. Heal Earth reserves the right to terminate the license if the School is found to be in material breach of these Terms, specifically regarding the unauthorized distribution of digital files or sprites.
Acceptance of Terms: By issuing a Purchase Order or completing a digital purchase, the School agrees to be bound by these Terms and Conditions.
